Duty to maintain safety

The duty to prevent foreseeable dangers to people in an opened or controllable area.

In brief

A person who opens, operates or creates a source of danger must ensure safety to a reasonable extent. The duty does not extend to every remote possibility.

Foreseeability, control, warnings and the reasonableness of safety measures must be assessed.
