When a tool, device or other item used for work is damaged, the question is not limited to the price of a replacement. The assessment must consider the condition before the event, whether a proper repair is possible and which costs were actually caused by the damage.

This article is for self-employed people, businesses and employees whose professional equipment has been damaged. It separates the property damage from a possible loss of earnings and explains which documents help assess repair, replacement and consequential costs.

Section 1323 ABGB places restoration of the previous condition first. If restoration is not possible, the estimated value is compensated. In cases of slight negligence, section 1332 ABGB refers to the ordinary value of the thing at the time of damage. The cause and degree of fault still require a separate assessment.

For a replacement, age, condition, features and the value of the damaged item matter as well as the price of the new item. Keep comparative offers and the reason for the chosen solution.

The damaged equipment and a possible loss of earnings are separate assessment items. Record the downtime, specific assignments and actual lost income separately from repair or replacement.

What can count as professional equipment

This may include tools, measuring devices, machines, technical devices, special protective or work equipment and business fixtures. The decisive point is not the label but the actual use and condition before the damaging event.

For items used both privately and professionally, the use must be explained clearly. Ownership, leasing, rental or equipment supplied by an employer may also affect the assessment. Keep purchase records, lease documents, inventory lists and handover records.

This article concerns compensation for a damaged item. A separate loss may arise if the equipment could not be used for a period. That possible loss of earnings is not automatically covered by the property damage.

Repair or replacement

First examine whether a proper repair is possible. An estimate should describe the damage, necessary work, replacement parts and additional work. A total amount without a technical explanation is difficult to verify.

If the item cannot be repaired sensibly or completely, the replacement needs a clear basis. The replacement does not automatically have to be new or technically more extensive than the damaged equipment. Features, performance and previous condition must be compared.

Section 1323 ABGB places restoration first. Whether repair or replacement is the correct form of compensation therefore depends on the actual possibility and reasonableness of restoring the previous condition. A decision based only on a list price is not enough.

Which value of the damaged equipment matters

For used professional equipment, age, wear, maintenance, technical development, remaining useful life and the condition immediately before the event may matter. The original purchase price does not automatically describe that value.

Section 1332 ABGB refers, in cases of damage caused by slight negligence, to the ordinary value of the thing at the time of damage. Whether this rule applies depends on the legal basis of liability and the degree of fault.

Record the serial number, year, features, maintenance, repairs and previous use. Comparative offers should concern technically comparable equipment, not merely items that look similar.

Keep consequential costs and loss of earnings separate

If equipment cannot be used temporarily, additional costs may arise, for example for a necessary rental or short-term substitute. Each item needs a concrete connection with the damage and supporting evidence.

A possible loss of earnings is a separate calculation. Show the downtime, affected assignments or work steps, expected income and saved expenses in a traceable way. A general statement that less work was possible will normally not be enough.

Which evidence should be secured

Take photographs from several angles and preserve the files with their dates. Record where and how the damage occurred. For substantial damage, a prompt technical assessment may be important before repairs or disposal alter the evidence.

Collect the purchase record, inventory or asset register, maintenance documents, operating data, estimate, repair invoice and comparative offers. For a replacement, the documents should show which functions are required for professional use.

Classify liability and insurance correctly

The cause, responsibility and insurance relationship must be kept separate. An insurance policy alone does not answer whether, and to what extent, a claim exists against another person.

If payment is reduced, ask for the calculation in detail. Which repair costs, value of the damaged item and replacement solution were used? Was a reduction based on age, improvement or lack of necessity?

Section 1324 ABGB distinguishes between full satisfaction and actual compensation according to the type of fault. Its relevance can only be assessed after examining the legal basis of the claim and the conduct that caused the damage.

How to prepare the assessment

Prepare a short chronology: use before the event, damage, notification, inspection, repair decision and replacement. Match each step with the relevant invoice, email or technical document.

List the positions separately. A table showing repair costs, value of the damaged equipment, replacement, necessary consequential costs and possible loss of earnings prevents different types of damage from being mixed.
